1:25 p.m. Update - ATLANTIC CITY — In a crucial victory for the United Auto Workers union, a federal labor board judge has ruled that dealers at Trump Marina Hotel Casino have the right to a second election after one held last year ended in a slim margin and accusations of casino misconduct.Administrative Law Judge Earl E. Shamwell Jr. ordered in a ruling dated July 18 that Trump Marina must not only set aside the results of the election from May 11, 2007, in which dealers voted 183-175 not to organize, but also refrain from “objectionable conduct,” including:- interrogating its workers about their union participation and activities.- threatening employees with job loss if they side with the union.- issuing written disciplinary warnings or suspensions to employees because of their union support and activities.
Almost a week after the election, the UAW filed an objection with the National Labor Relations Board, accusing the casino of threatening and intimidating employees in favor of organizing and favoring instead those who were anti-union.A spokesman for the casino’s parent company, Trump Entertainment Resorts Inc., said at the time that the casino’s campaign was “certainly clean and by the books” and the UAW’s loss reflected that the majority of dealers did not want to organize.See Wednesday's edition of The Press for additional coverage.
