On May 24, Fuss was driving his truck westbound on the Egg Harbor Township road when he crossed the center line and collided head-on with Hayes' vehicle, according to the Atlantic County Prosecutor's Office.

Hayes and his wife, Patricia, 69, had to be extricated from the front seat of their sport utility vehicle. Both were transported to AtlantiCare Regional Medical Center, City Campus, where Thomas Hayes died the following day. His wife's injuries were not life-threatening.

Fuss was taken to Shore Medical Center, where he was treated and released.

In addition to the vehicular homicide charge, Fuss has been issued multiple summonses, including reckless driving and DWI.

He was arrested Friday and lodged at the Atlantic County Justice Facility in lieu of $50,000 bail.
