Eagles file suit against West A.C. radio station

The Philadelphia Eagles want to sack a radio station's practice of giving away tickets to the team's football games.

In a recently filed 124-page lawsuit against WZXL-FM 100.7, based in the West Atlantic City section of Egg Harbor Township, the Eagles allege:

The Eagles have made repeated efforts to persuade Equity to cease the conduct. On Sept. 11, counsel for NFL Properties sent Equity a letter demanding that it discontinue permanently all uses of NFL tickets, including Eagles tickets and NFL trademarks, including Eagles trademarks, in connection with contests, giveaways and promotions.

The lawsuit wants to keep Equity from permanently using Eagles or NFL tickets or trademarks without written authorization. It also wants Equity to reveal its profits from all Eagles-related activity and to pay the Eagles an amount equal to three times the profits or damages, whichever is greater.

Neither Gary Fisher, president and owner of Equity Communications, nor Philadelphia Eagles attorney Bruce Keller could be reached for comment Friday.

The downturn in the economy has led to a rise in disputes between teams and stations over use of trademarks, according to attorney Paul Rotella, president and chief executive officer of the New Jersey Broadcasters Association.

"To the extent that they are doing something that is illegal or violates trademark copyright laws, they may also have some FCC concerns, too," said Rotella, who had not seen the lawsuit.

Philadelphia's WYSP-FM 94.1, a CBS radio station, is the Eagles' official radio station. Eagles games also are broadcast on WMGM-FM 103.7 in Linwood.
