A state appeals court said Sea Isle City lifeguards cannot be sued after one of their rescue kayaks floated away from a lifeguard stand and smashed into a grandmother's leg in 2005.

Margaret Kelly had sued Sea Isle City and its beach patrol after the accident, which fractured her left tibia and fibula.

An appellate court this week dismissed her personal injury suit, saying the kayaks were placed near the water's edge in case of a rescue.
