Former Wildwood Mayor Gary DeMarzo was previously indicted in March 2011, prior to the May 2011 election, which he lost.

Other notable Cape May County indictments that have been dismissed:
* Superior Court Judge Raymond Batten on Dec. 3, 2009, dismissed a 124-count indictment for health care claims fraud and conspiracy pending against North Wildwood physician John Costino and his wife, Barbara, due to a lack of specifics in the lengthy indictment.
* In March 2011, Batten dismissed another fraud indictment against Costino after determining that prosecutors presented incorrect information to a grand jury. Costino was indicted on drug-distribution charges in January 2011 under a superseding indictment. He was initially indicted on those charges in 2008. That case is pending trial.
* On Oct. 7, 2009, Batten dismissed the indictment against murder suspect George J. Carty III, an Ohio doctor charged with murdering Lower Township resident Richard Attenborough in 1982 because a detective misled the grand jury with regard to DNA evidence found at the scene. On Oct. 20, 2009, a second grand jury indicted Carty on the same murder charge, but on Oct. 6, 2011, the Prosecutor’s Office submitted an order seeking to dismiss the murder indictment without prejudice after an appellate court ruled that a statement in the case was inadmissible.
