A Stafford Township driver has been indicted on a second-degree vehicular homicide charge in the death of a 76-year-old Barnegat Township man whom he allegedly struck and killed Sept. 21, 2011.

Robert Kusznikow, 26, was indicted by an Ocean County grand jury Wednesday, Executive Assistant Prosecutor Michael Paulhus said.

Kusznikow is the son of Stafford Township Councilman Robert Kusznikow.

The charge falls under the No Early Release Act, meaninig if Kusznikow were found guilty of the charge he would have to serve 85 percent of his sentence, Paulhus said.

According to the indictment, Kusznikow operated his pickup truck recklessly and while intoxicated, striking and killing Michael Grosso Jr.

Grosso died of multiple traumatic injuries, authorities said, after he was allegedly struck by Kusznikow’s pickup truck while standing next to a parked SUV on Mermaid Drive in the Ocean Acres section of Stafford Township.

In October 2011, Kusznikow was cited by authorities for reckless driving and failure to maintain a lane. Kusznikow’s license was previously suspended seven times and he lost his license three times for driving under the influence of drugs or alcohol.

Kusznikow has remained in the Ocean County jail in Toms River on $150,000 bail with no 10 percent option after authorities arrested him in December on charges of vehicular homicide and assault by auto while under the influence.
