Atlantic City Fire Department Capt. Roderick Knox, 47, of Egg Harbor Township, has been reinstated and stands to receive back pay.

A suspended Atlantic City fire captain acquitted last year of charges he had sex with his teenage foster daughter will go on trial Monday in a similar case.

Roderick Knox, 47, was arrested two years ago on charges he had sex with the 15-year-old girl living with him and his family in their Egg Harbor Township home. A jury in October found him not guilty of all 13 counts.

But during the investigation into that case, detectives found another woman who said that, in 1995 — when she was 15 — Knox had sex with her.

This past November, Superior Court Judge Bernard DeLury rejected a motion to dismiss those charges. A jury was selected Wednesday, and opening statements are expected to begin Monday morning.

Knox has been suspended without pay from the job he’s held for nearly 20 years since shortly after his arrest in February 2011.

“We have always been, and still remain, confident that these charges will be shown for what they are: completely false,” defense attorney Stephen Funk said. “Other than that, now that a jury has been seated, we look forward to doing our talking in court.”

After his acquittal in October, Knox said he had been sickened by the charges.

“It was the most hideous thing you could be accused of,” he told The Press of Atlantic City at the time. “I can’t stand people that do stuff like that.”

Assistant Prosecutor John Flammer will represent the state.
