Two brothers have been arrested in the Sunday night killing of an Atlantic City man.

Malik and Mykal Derry were arrested at the Motor Vehicle Commission in Egg Harbor Township's Shore Mall at about 1:30 Monday afternoon, acting Atlantic County Prosecutor Jim McClain said.

It was not clear why they were at the Cardiff office.

Tyquinn James, 25, was found shot in the head outside the Mecca Chicken on Adriatic Avenue in Atlantic City at about 7:30 p.m. Sunday. He was pronounced dead at the scene, becoming the first homicide of the year in Atlantic County.

The brothers were apprehended by members of the Atlantic County Prosecutor's Office, the FBI and the Atlantic City and Egg Harbor Township police departments.

Malik Derry, 21, has previous arrests as a juvenile. He was sentenced at 16 years old for resisting arrest and for assaulting a corrections officer at 17.

Mykal Derry, 32, has several robbery and drug arrests, dating to 1999, court records show. He most recently pleaded guilty to conspiracy in an assault case. He served 142 days in the Atlantic County Justice Facility.

Both men are now charged with murder, conspiracy to commit murder and weapons offenses. Their bail has been set at $1 million each.

They will have their first appearance on the charges before Superior Court Judge Michael Donio at 1:30 p.m. Tuesday.

James had been the victim of two previous shootings in the city, including one New Year's Day 2011.

He also had several previous drug and assault arrests, including an indictment last January on obstruction of the administration of the law. He pleaded guilty to a fourth-degree crime.
