EAST RUTHERFORD, N.J. (AP) — A judge in New Jersey is dropping charges against a former student accused of drawing swastikas if the man can prove he's enlisted in the Marine Corps.
Dean Kaye of Carlstadt had pleaded not guilty last month to criminal mischief. But the 18-year-old told the judge he planned to join the Marines after graduation from Becton Regional High School.
Kaye was accused in April of drawing two swastikas in a school bathroom.
A Marine recruiter appeared in court on Wednesday to tell the East Rutherford judge that Kaye had applied to enlist but would not be accepted if he had an outstanding charge.
